Need Legal Advise about ex-husbands 401K / Retirement Money !!!?
Q. Asking for my mom... She was married 21 years and in the divorce she was awarded 1/2 his 401K / Retirement money for the years they were married. Now she wants to find out how much he has. He said that there is not that much in there. But won't give an exact amount. She is trying to find out w/o a lawyer due to expensive lawyer fees. Someone told her that if he took any money out that he could be charged, since it was court ordered that she would recieve half. Any advise would be helpful! Thanks.

A. There are a ton of Habitat for Humanity 401k plans. In fact there are 20 different Habitat for Humanity entities that offer a 401k plan. Habitat for Humanity International in Americus Georgia offers a retirement plan and a 403b plan. The phone number is 912-924-6935. If you worked for an entity that wasn't based in Americus, Georgia then I would need to know where your HfH entity was based to give you a better #.

A. Absolutely the Roth IRA. The Roth gives you no tax deferment now (which means you'll pay tax on the principal) but, and this is really really key, you pay no tax on the interest earned over time!! And believe me, the power of compound interest is insane. It is very possible that the 512 dollars you put in this month could be work $5120 dollars when your 65, and you pay no tax on $4608 of it. Zero. No tax. Now imagine that every single month. Even at that meager amount, $512 a month (with a maximum of $5000/year), you WILL be a millionaire at 65, and with no tax debt! That truly is incredible. The longer you wait to invest, the less the power of compound interest. So much so that if you fully invest the maximum in a Roth IRA… [cont.]
